Set to begin January 3, 2012 – The FMCSA & PHMSA are restricting the use of hand-held mobile telephones by drivers of commercial motor vehicles. (CMV’s). Click HERE for more Detail |

The FMCSA Cell Phone Ban means: Drivers cannot use a handheld phone which requires: 1. The use of at least one hand to hold phone and talk 2. The use of more than one button to dial 3. Reaching for device which required the driver to move beyond seated position restrained by a seatbelt Drivers can use: 1. Completely hands-free and voice activated phones 2. CB radios Fines that can be issued as a result of violating this rule: 1. Employers can receive a civil penalty up to $11,000 2. A driver may be fined up to $2,750 for a single violation This fine is also a “serious traffic violation” under 49 CFR 383.5 that may result in: 1. A driver who violates this rule twice in a 3-year period: disqualified from operating a CMV for at least 60 days 2. A driver who commits 3 or more violations within a 3-year period: disqualified from operating a CMV for at least 120 days. Nothing in this rule, however, will allow a law enforcement official to require a driver show their mobile telephone so the office can review call history. |
